Modified dispute resolution provisions for BOT (Toll), HAM and EPC projects issued in accordance with the Ministry of Finance guidelines on arbitration and mediation in public procurement contracts.
This document provides the modified chapter on Dispute Resolution for BOT (Toll), HAM and EPC projects of the Ministry of Road Transport and Highways. It establishes procedures for amicable resolution and escalation of disputes and specifies mechanisms for arbitration, conciliation and mediation based on the value and nature of disputes. The provisions include referral of disputes below ₹10 crore to SAROD or IIAC, resolution of disputes of ₹10 crore and above through conciliation, treatment of declaratory and non-monetary disputes, applicable arbitration procedures, venue, costs, enforceability of awards, and continuation of contractual obligations during dispute resolution. The modified provisions supersede the existing dispute resolution provisions with immediate effect, except for ongoing arbitration matters, which continue under the provisions applicable before the amendment.
