PLEASE NOTE THAT YOUR USE OF AND ACCESS TO AIKOSH SERVICES (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS OF USE. IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.

These Terms of Use ("Terms") govern the access and use of the AIKosh Platform (“AIKosh”), its services, applications, and products (the “Services”). AIKosh is a platform designed, developed and hosted by the IndiaAI Division under the Ministry of Electronics and Information Technology (“MeitY”), Government of India.

You must agree to and accept all of the Terms, or you do not have the right to use the Services. Your use of the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document, as well as those in the Privacy Policy and the Community Guidelines. In these Terms, the words “include” or “including” mean “including but not limited to”, and examples are for illustration purposes and are not limiting. 

AIKosh may also post and update supplemental terms ("Supplemental Terms") at AIKosh.indiaai.gov.in/policies, and such Supplemental Terms will also apply to you.

"Account" is the account that you, or your entity, will create on AIKosh to access and use the Services. 

"Terms" refer to all of the terms and conditions that apply between AIKosh and you. They include these Terms, Supplemental Terms, notices and policies available at AIKosh.indiaai.gov.in/policies and/or any other binding document that AIKosh provides and/or that you sign, as part of accessing the Services of AIKosh. 

“Artefact” refers to any dataset, model, tool, or library uploaded, shared, or otherwise made available by a User on the AIKosh Platform, including but not limited to machine learning models, datasets, evaluation scripts, and software libraries. Artefacts may be provided by the various Organizations, Departments, and Ministries of the Government of India or Non-Government Contributors.

"Content" refers to any material posted, displayed, or accessed on AIKosh, including but not limited to datasets, models, code, text, graphics, images, applications, or software you, IndiaAI, or any third party provides or makes available. Content includes all Artefacts as well as User created posts, comments, and other community contributions. 

“Contributor” refers to any User who uploads, submits, shares, or otherwise makes available any Content, including datasets, models, tools, documentation, or other materials or artefacts, on the AIKosh platform.

"My Notebook", or "Integrated Development Environment" refers to the development environment on the AIKosh Platform that allows Users to interact with Artifacts, including datasets and models, including building, evaluating, processing, sharing, and versioning them.

"Model" refers to a pre-trained machine learning model, including algorithms and weights, which can be run to make predictions.

"User" refers to the individual person, company or organization that accesses, receives, or uses the Services. 

AIKosh is a unified dataset platform that streamlines access to non-personal and anonymized datasets as well as AI Models, tools, and libraries. AIKosh connects government and non-government Contributors with users of AI resources. The key features of AIKosh include, but are not limited to:

• Datasets Repository: A collection of non-personal, anonymized datasets contributed by Users, available for access, reuse, and further development under specified licenses and end-use terms.
• Model Hub: A repository of AI models that Users can reuse, fine-tune, and validate, subject to applicable license and end-use terms.
• Use-Case Library: A central repository for exploring, understanding, and contributing practical AI use cases and their associated artefacts.
• My Notebook: A workspace for coding, testing, processing, sharing, and versioning models, datasets, and other artefacts.
• Toolkits: Collection of software components, tools, scripts, and development utilities for seamless integration into User projects.

You must use the Services in strict compliance with these Terms, any applicable Supplemental Terms, all of AIKosh policies available on AIKosh Website (AIKosh.indiaai.gov.in), and all applicable laws or regulations in the relevant jurisdiction(s).

AIKosh may update, modify, expand, suspend, discontinue, or introduce new Services (or any part thereof) at its discretion. Any such changes will be subject to these Terms and any additional terms or policies applicable to the new Services as made available on the platform. You agree that AIKosh will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

To access certain Services on the AIKosh platform, you may need to create an Account for yourself or your organization. If you create an Account on behalf of an organization, you represent that you have the authority to act on behalf of the Organization and bind the Organization to these Terms (in which case, the references to “you” and “your” in these Terms, except for in this sentence, refer to that organization or entity).

You are solely responsible for maintaining the confidentiality of the information you hold for your Account, including your password, and for any and all activity that occurs under your Account, including as a result of your failure to keep this information secure and confidential. AIKosh is not liable for any loss or damage arising from your failure to secure your Account information.

In order to create an individual User account and perform necessary authentications, AIKosh relies on the services of MeriPehchaan.  By creating an individual account, you consent to MeriPehchaan's Terms of Service and Privacy Policy.

To create an organization account and perform necessary authentications, AIKosh relies on Entity Locker's services. By creating an organization account, you consent to the Terms of Service and Privacy Policy of Entity Locker. 

When you create your Account, AIKosh may ask you to provide basic information, such as your email address, username, full name, and other optional information, such as your profile picture. You must provide accurate, complete, and up-to-date information. For details on how your personal information is stored and processed, please refer to our Privacy Policy.

You may not transfer your Account to anyone else without our prior written permission.

You are solely responsible for the Content you post, publish, display or otherwise make available on AIKosh, and for any other action or omission that results from your use of the Services (including our Content or other Users' Content), or the use by a person or an entity that you have authorized under your Account. You represent and warrant that you have ownership, control, and responsibility for the Content you post or otherwise make available on AIKosh, or otherwise have the right to do so. Your Content must not be misleading or unlawful, and must not violate any of these Terms, applicable laws and regulations, or infringe or misappropriate any rights of any person or entity. 

You represent, warrant, and agree that you will not contribute any Content or otherwise use the Services or interact with the Services in a manner that:

1. Is harmful, threatening, harassing, defamatory, pornographic, obscene, or otherwise objectionable;
2. Defames, abuses, harasses, threatens or violates the legal rights of others
3. Contains viruses, Trojan horses, worms, and corrupted files.
4. Violates any other User or party’s intellectual property rights 
5. Create a false identity for the purpose of misleading others.
6. Violates these Terms.
7. Violates the Community Guidelines of AIKosh;

Without limitation to any other remedies available to AIKosh, a violation of any of the foregoing is grounds for termination of your right to use or access the Services. AIKosh does not actively pre-screen Content but reserves the right, at its sole discretion, to refuse or remove any Content or Account for the reasons mentioned above (as well as if your Content is flagged by the platform community to be in violation of these Terms), and without prior notice.

By posting/uploading/hosting your Content or otherwise making it available on AIKosh, you grant AIKosh a worldwide, royalty-free and non-exclusive license to use, display, publish, reproduce, distribute, and make derivative works of such Content to provide Services and as otherwise permitted under these Terms and our Privacy Policy. 

AIKosh enables the Contributor to determine the access and usage rights of Artefacts contributed or otherwise made available on the platform:

• If the Artefact is made available under open access, it will be discoverable by any User and downloadable by any registered User of the platform.
• If the Artefact is made available under restricted access, it will be discoverable by any User; however, its download and use will only be possible with the explicit consent of the Contributor. 
• If the Artefact is private, it will only be discoverable and downloadable by the Contributor. 

AIKosh provides Contributors with a dropdown of commonly used licenses to define the terms of end use for their Artifacts. If you would like a license to be added to this list, please contact us. AIKosh is not responsible for any breach of license terms by other Users.

When Content is made available under a particular license, (such as an open source license) such Content is intended to remain under the terms of such license when further accessed, distributed, or used. Neither party is permitted to remove reference to any such license.

Any Content you download, access or use from us or another User, is at your own risk and subject to these Terms and/or the terms accompanying such Content. 

This Linking Artefacts feature is intended to enhance the discoverability of contributed artefacts (datasets/models) by highlighting when other users have referenced them in developing their own artefacts.

Contributors may associate artefacts such as datasets or models through AIKosh’s linking or referencing features. These links are Contributor-generated and do not imply verification or endorsement by AIKosh. Contributors ‘linking the artefacts’, are solely responsible for the accuracy, appropriateness, and compliance of such associations. AIKosh shall not be held liable for any errors, omissions, or consequences arising from incorrect, misleading, or unlawful artefact associations.

This feature is intended to enhance the discoverability of datasets or models or artefacts by highlighting when other contributor have referenced them in developing their own artefacts. However AIKosh shall not be held liable for any errors, omissions, or consequences arising from incorrect, misleading, artefact associations.

All artefacts made available on AIKosh under open or restricted access may be freely linked or referenced by other Users within the platform to enable discoverability, workflows, and composite solutions.

For the feature, Contributors may associate artefacts such as datasets or models through AIKosh’s linking or referencing features. These links are Contributor-generated and do not imply verification or endorsement by AIKosh. Contributors ‘linking the artefacts’, are solely responsible for the accuracy, appropriateness, and compliance of such associations. 

You may delete your Account whenever you want, at your sole discretion. AIKosh may do the same and reserves the right to suspend or terminate your access to the Services anytime with or without cause, and at its own discretion, with or without notice.

Upon termination of your Account, AIKosh will use commercially reasonable efforts to delete your information and Content contributed by you, whether public or private, within 90 days. AIKosh will not delete the Content that you contributed to other Users' Artefacts, including versions of it and Content made on the community module of the platform. 

AIKosh reserve the right to retain your information for legal or regulatory compliance, pursuant to standard archiving, recovery, and back-up processes and practices, and pursuant to AIKosh’s Privacy Policy.

For certain Services, the Service Term and causes for termination may be specified in the Supplemental Terms and/or in any other binding document.

Government of India will retain ownership of all intellectual property rights related to the AIKosh website and the Services, including all improvements to the Services. Any material produced by IndiaAI, Ministry of Electronics and IT or Government of India, including the Website, design, code, graphics, interfaces, trademarks, and logo shall remain exclusive property of Government of India. You may not copy, alter, reproduce, republish, license, sell or otherwise exploit for any purpose any proprietary materials unless you are expressly given written permission to do so by IndiaAI. All rights not expressly granted are reserved and retained by the Government of India.

AIKosh grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, subject to and in accordance with our Terms. This license is for the sole purpose of enabling you to use our Services in the manner permitted by our Terms. 

You retain any intellectual property rights that you have Content contributed by you. AIKosh does not claim ownership of any of your Content, including any datasets, models or other Artefacts that you upload or otherwise make available on AIKosh. 

Certain Services may be governed by specific intellectual property terms, which are stated in the Supplemental Terms and/or in any other binding document.

Certain items provided with the Services may be subject to specific license terms, as chosen by the Contributor. The license terms are not intended to be replaced or overridden by the terms of these Terms; however, the limitations of liabilities, disclaimers, and this provision apply to any such item as well. Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable license.

If you believe someone is infringing your intellectual property rights, you may submit a notice to AIKosh at support-indiaai@indiaai.gov.in for reasonable and appropriate action. For example, AIKosh may take down the particular Artefact and suspend service for repeat copyright infringers.

AIKosh will provide the Services in accordance with our Privacy Policy

Contributor Access to Download Metrics and User Identity

This is to facilitate visibility and communication between Users and Contributors, which may include sharing the User’s name, email address, and usage with the Contributor of an artefact accessed or downloaded by the User, solely for the purposes of usage insight and potential follow-up; AIKosh does not verify or assume responsibility for how such information is interpreted or used by the Contributor.

You agree not to use the Services for any unlawful purpose or in violation of these Terms, conditions, or notices. You will not engage in any activity that could damage, disable, or overburden AIKosh’s servers or networks or interfere with another User's access to the Services. Additionally, you will not attempt to gain unauthorized access to any Services, accounts, or networks connected to AIKosh’s servers through hacking, password mining, or any other unauthorized means. 

You will not use any network monitoring or discovery software to determine the site architecture or extract information about usage, individual identities or Users. You will not use any robot, spider, other automatic software or device, or manual process to monitor or copy AIKosh Content without prior written permission from IndiaAI. The use of any software (e.g., bots, scraper tools) or other automatic devices to access, monitor or copy the AIKosh website pages is prohibited unless expressly authorized by IndiaAI in writing.

The Services may contain links, information or connections to third-party websites or services that are not owned or controlled by AIKosh. A link to a third-party website does not mean that AIKosh endorses the content or use of such website or its owner. When you access third-party websites or engage with third-party services, you accept that there are risks in doing so, and that AIKosh is not responsible for such risks. You are encouraged to be aware when you leave the Services and to read the terms and privacy policy of each third-party website or service that you visit or utilize. 

AIKosh has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third-party websites or by any third party that you interact with through the Services. In addition, AIKosh will not and cannot monitor, verify, censor or edit the content of any third-party site or service. By using the Services, you release and hold IndiaAI, Ministry of Electronics and IT, and Government of India harmless from any and all liability arising from your use of any third-party website or service.

If there is a dispute between participants on this site, or between Users and any third party, you agree that AIKosh is under no obligation to become involved. If you have a dispute with one or more other Users, you release AIKosh, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes or the Services.

You are solely and exclusively responsible for your use of the Services. 

In this regard, you agree to indemnify, defend and hold harmless AIKosh from all claims, liability, and expenses, arising out or in connection with your use of (or inability to use) the Services, including but not limited to your violation of these Terms, applicable law or regulation, any Content or data posted or used by you, or any other party's use of any Service with your credentials. 

If your use of the Services is prohibited by applicable laws, then you are not authorized to use the Services. AIKosh will not be responsible for your use of the Services in a way that breaks the law.

AIKosh provides Services that you may or may not decide to access, use or purchase. In this regard, AIKosh makes no warranties or representations about these Services. Except as expressly provided otherwise herein, and to the fullest extent permitted by law, the Services and Content are provided "as is" and "as available". 

AIKosh disclaims all warranties or guarantees about the accuracy, reliability,  copyright or license compliance, or benefits of any Services, including any datasets or models, or any other technology or Content, or that the Services or Content will meet your requirements, be secure, uninterrupted or available at any time or location, or error-free, viruses-free, or that any errors will be corrected, or otherwise.

You will be solely responsible for any damage resulting from your use of or access to the Services, your downloading of Content or data, or use of any other material provided by or through the Services.

AIKosh cannot control and has no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you release IndiaAI, Ministry of Electronics and IT, and Government of India from all liability for you having acquired or not acquired Content through the Services. 

AIKosh disclaims all warranties or guarantees of any kind, express or implied, whether arising under any law or from any usage in trade, or otherwise, including but not limited to the implied warranties of merchantability, non-infringement, fitness for a particular purpose, or otherwise.

AIKosh will not be liable for any indirect, incidental, consequential, punitive, special, or other similar damages, including loss of revenue, profits, data, benefits, or savings, whether or not due to the fault or negligence of the company or related parties, and regardless of whether either of us or our related parties have been advised of the possibility of such damages or losses.

These Terms shall be governed by and construed in accordance with the Indian law. Any dispute arising under these Terms shall be subjected to the exclusive jurisdiction of the courts located in New Delhi only.

AIKosh may change or update the Terms from time to time. Changes will be effective 10 days following posting on the Website. If you continue using the Services 10 days following such posting, that means you accept those changes.

If you provide us feedback regarding the use, operation, performance, or functionality of our platform or Services (collectively, "Feedback"), you hereby grant AIKosh a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive right and license to utilize and commercialize the Feedback, improve the Services, and develop and/or commercialize new offerings, which will solely and exclusively be owned by IndiaAI,  or any other agency of Government of India.
