This privacy policy (“Policy”) is in the context of and to govern the access and usage of the AIKosh website (“Platform”) and its services and products including Artefacts (collectively, “Offerings”) by the user, whether registered or not (referred to as “User”, “you”, or “your”). 

AIKosh (referred to as “we”,  “us”, or “our”) is a platform designed, developed, hosted and operated by the IndiaAI Division established as an independent business division  under the Digital India Corporation by the Ministry of Electronics and Information Technology, Government of India. 

We request you read the terms of this Policy in conjunction with our Terms of Use (available here) before accessing our Offerings. By using our Platform and Offerings, you consent to the terms of this Policy and to our processing of your personal data or information in the manner and for the purposes set forth herein. In case you do not agree with any of the terms of this Policy, we strongly advise you to refrain from accessing our Platform and Offerings.

We reserve the right to modify or update the Policy at any time. The modified or updated version will be effective immediately upon publication by us on this page, with the effective date mentioned at the top. Your continued access and use of our Platform and Offerings following such change constitutes agreement on your part to abide and be bound by the modified or updated version of the Policy. To this end, we encourage you to review the Policy each time you access and use our Platform and Offerings. 

The Policy explains what types of data we collect relating to you and how and why we use it when you access and use our Platform and Offerings. It aims to apprise you of our privacy practices relating to the processing of your personal data. The following terms cover the various categories of personal data collected, manner of processing (collection, use, retention, disclosure,) of such data, and your associated rights under applicable laws in India.

We collect certain data or information that identifies you or may identify you, for the limited purposes outlined in the Policy. Personal data or information means any information that can, alone or in combination with other information, be used to identify an individual, for instance by reference to a name, username, email address, photograph, IP address, etc.

In case, any non-personal data or information (such as Usage Data explained below) is specifically connected or linked to any personal information we treat it as personal information, as long as such connection or linkage exists.

From your use of the Platform:

We allow the User to browse through our platform without signing up. For such unregistered User, we do not capture any specific personal data such as, name, title, phone number, email ID that may enable us to identify them individually. However, we automatically receive data about your (for both registered or unregistered User) interaction with and activities on our Platform to help maintain your preferences across browsing sessions or enhance your experience and the performance of the Platform (“Usage Data”). To this end, we may access and retain the Platform related Usage Data about you, such as:

• how you came to our Platform and the web pages you visited
• time spent on those pages, access times and dates and other similar information
• data collected through use of cookies or similar tracking technologies that uniquely identify your browser, computer or device you are using such as your computers’ operating system and Internet Protocol (IP) address.

From your use of the Offerings: 

For the on-boarding process and provisioning of our Offerings, we access basic information about you such as name, postal address (home/office), email address, identifying documents mobile number, User name, Organization name and related details, which may include your designation and role, supervisor’s details, and organisational identification documents. 

While accessing our Offerings such as services like Utility Repository, Notebook, and Model Try-out, we may have to retain the data created, uploaded or shared by you temporarily to facilitate your interaction /engagement with our Offerings. It is recommended that you create, share or upload data which is non-personal in nature. However, in accessing the said services, should you choose to create, upload or share data which may contain personal or sensitive personal data of third parties / persons/ entities, you are strongly advised to ensure that you have the right to do so under applicable laws. 

We do not warrant, endorse, guarantee, or assume any responsibility, liability, or contravention arising out of or in connection with the data or information or Artefacts available on our Platform or Offerings. Hence, you are encouraged to exercise caution and care in accessing any data or information or Artefacts available on our Platform or while interacting / engaging with our Offerings. 

We automatically collect data relating to your interaction, usage, and consumption of our Offerings, and for the performance, operation, and administration of our Offerings, which may entail personal information:

• technical information, or data obtained from APIs, software or systems hosting the Offerings and devices accessing these Offerings, log files generated during such use;
• data and metadata about a registered User, such as User ID and email, and
• data and metadata about a registered User’s activities and behaviour while interacting or consuming our Offerings, such as number of clicks  and feature utilization, browser and connecting software.

Cookies

We may collect data through the use cookies or similar technologies for the purposes of delivering, updating, monitoring, improving our Offerings, and maintaining security by detecting, preventing and responding to any type of threats or incidents.

You have the option of disabling cookies in your web browser / device settings. However, if you choose to disable the cookies, you may not be able to access and use some parts of our Offerings in the manner they were designed and intended to function. 

When you communicate with us:

We may collect your name, User name, title, email and postal address, mobile number, audio transcripts (for the purposes of Helpline only), and other information you provide when you communicate with us (via email, telephonically, social media sites) for submitting inquiries and requests, providing feedback about our Offerings / Platform or for registering for marketing related activities. Under no circumstances, we will monetise your data for marketing purposes.

We may link to third-party service providers or websites or applications on our Platform, or in our Offerings for purposes outlined in the Policy. In this respect, the data we collect, use, and disclose via the Platform or the Offerings will be subject to this Policy. However, your use of third-party service providers or websites or applications including availing what they offer (via clicking and accessing third-party service providers or websites or applications) or sharing of any information will be bound solely by the respective third-party’s terms and conditions and privacy policies. In these circumstances, we will not be held responsible for your interaction/ engagement with them. You are to ensure that prior to engaging or sharing any data with such third parties, you fully understand their terms and condition and privacy policies. 

We may use your personal data/ information to:

• Fulfil our contractual obligations towards you;
• Provide you with our Offerings;
• Develop new Offerings (services and products);
• Operate and improve the existing Offerings;
• Diagnose or resolve issues;
• Enhance User experience;
• Conduct research and analysis;
• Conduct data analytics, understand User engagement and behaviour;
• Understand and identify the User type and the User respectively;
• Facilitate communication with the Users, which may include updates, notifications for events, promotions, and marketing related activities, security alerts, response to queries, and such other communication as we deem necessary;
• Ensure and maintain the security of our Platform or Offerings, which may involve measures related to prevention, detection, investigation of violations, misuse, fraud, or illegal activity;
• Enhance and optimise our systems, processes, security, and operations;
• Protect the rights or safety of AIKosh, Users, or the public; and
• Comply with legal obligations.

We do not share/disclose User data or personal data or information for purposes other than those provided in this Policy or where it has been de-identified. 

As a unified AI Platform, we streamline access to Artefacts (which includes non-personal and anonymized datasets, AI models, toolkits, applications, and use-cases) contributed by registered users classified as ‘Contributors’ (defined under the Terms of Use). In accessing / downloading the Artefacts, you understand that we may enable the ‘Contributors’ to access certain data about you such as your name, profile and your interaction with their Artefact on the Platform. 

We implement all appropriate and reasonable measures to ensure that your data is retained and processed only for so long as is necessary for purposes enumerated under the terms of this Policy.

We have adopted all appropriate and reasonable measures to protect your personal data or information from loss, misuse, unauthorized access or disclosure, alteration, or destruction. 

We use industry-standard information, features, security tools, and measures, as well as internal procedures and strict guidelines to protect the confidentiality and security of your data. We have implemented appropriate technical and organisational measures to protect your personal information which may include: encryption, internet firewalls, intrusion detection and network monitoring depending on the nature of the information and the scope of processing.

While we ensure that your data is encrypted upon receipt as well as during transmission, no method of electronic storage or transmission over the internet is fully secure or guarantee absolute security. For this reason, you are advised to practice caution and care in deciding your engagement with our Offerings and Platform. We are not responsible for consequences emanating from malicious breach of our safeguards and protocols. Your use of our Platform and Offerings or reliance on them is solely at your own risk.

You have the right to access your personal information at any time and to update your personal data except that which enables access to your account.

You may delete your AIKosh account at any time subject to transfer or deletion of the contributions (such as Artefacts) made by you. Upon receiving request for termination of your account, we will use commercially reasonable efforts to delete your data. Such deletion will not have any adverse impact on the data or content that you may have contributed previously and/ or forms part of other Users' Artefacts and data incidental to it, including versions of such Artefacts accessible on the Platform.

You also have the right to revoke / withdraw your consent to the processing of your personal data. However, in such a scenario, we may not be able to provide you access to our Platform and Offerings.
